Requirements for International Mobility Program: Intra Company Transfer (ICT)

Companies must meet several requirements to be qualified for a work permit.

General Requirements

  • It would help if you were employed by an international organization looking to enter Canada as a subsidiary branch or an affiliate of that company.
  • You seek to undertake employment at a continued establishment of the organization.
  • You are being transferred and promoted as an executive, senior manager, or professional with specialized knowledge and capability.
  • You are employed for a long time with the organization which plans to transfer people outside in a full-time capability for at least one year of the three years, immediately before the date of the application.
  • Your work in Canada is on a temporary basis only.
  • You must comply with all the immigration rules and requirements for a temporary entry.

Company Requirements

The company must have its own physical premises to run its business operation in Canadian, especially where specialized knowledge is involved. However, if the transfer involves senior managers or executives, there is some flexibility offered. The executives may not get a residence on lease immediately. In such cases, the company can use its counsel’s address until the executive can purchase or lease a premise.

The company must provide realistic plans to staff the new operation.

The company must demonstrate the financial capability to begin business operations in Canada and provide monetary compensation to its employees.

When transferring executives or managers, the company must show its capability to support executive or management functions.

When transferring a specialized knowledge worker, the company must provide evidence it is expected to be doing business.

They must also ensure that work is guided by management handling the Canadian side of business operations.

Documents Required for ICT Canada

  • Papers that show that the foreign national is employed by a multinational enterprise outside Canada and want to work in a branch, subsidiary, or affiliate of that organization in Canada
  • A confirmation that the foreign national is employed full-time by the enterprise outside Canada, in a similar position, for at least one year of the three years immediately before the date of application
  • Documents that outline the position of the applicant in an executive or managerial capacity or with specialized knowledge
  • In the case of an applicant with specialized knowledge, there should be documentary evidence the person has such knowledge. It must also be established that the position in Canada requires such knowledge.
  • The applicant’s position, such as job title, job description, place in the organization, etc., must be clearly indicated.
  • The intended duration of stay in Canada must be provided
  • Tangible proof of the relationship between the enterprise in Canada and the foreign country

Time Taken For Processing Intra-Company Transfer to Canada

The average time taken to complete the ICT in all respects may range from two to ten weeks. However, organizations can use the priority processing options if they want to get the visa faster. This option is available for visa-exempt countries. The two-week completion period does not include biometric processing.

Validity of the Intra-Company Transfer Visa

The Intra-Company Transfer visa is valid for one year. For renewal at the end of the period, companies must prove that:

  • The Canadian and foreign companies continue to enjoy a qualifying relationship
  • The establishment has been carrying out continuous supplies of goods or services for the past year
  • The new office is well staffed
