How to Expedite Your Spouse or Partner’s Immigration to Canada

The concept of family reunification lies at the heart of Canada’s immigration policies, particularly concerning the sponsorship of spouses and partners by Canadian citizens and permanent residents (PRs). Despite the broad scope of family reunification, the spotlight often falls on facilitating the reunion of spouses and partners, making it one of the most popular methods of immigration to Canada, second only to economic immigration.

Statistics from the 2023 Annual Report to Parliament on Immigration by Immigration, Refugees and Citizenship Canada (IRCC) underscore this trend. The report reveals a steady increase in the number of sponsored spouses and partners admitted to Canada, despite a temporary decline in 2020 due to the COVID-19 pandemic. However, alongside this increase, the processing times for sponsorships have also lengthened, from 13 months in 2019 to 18 months in 2022, as reported in the same document.

To address the prolonged separation between Canadian citizens/PRs and their families, IRCC offers two options to expedite the immigration process for spouses and partners.

Option 1: Open Work Permits

Spouses, common-law partners, and conjugal partners being sponsored for permanent residence in Canada may qualify for a Spousal Open Work Permit (SOWP) under specific conditions:

  • Demonstrating a genuine relationship with the sponsor
  • Inclusion in an application for permanent residence, with an Acknowledgement of Receipt (AOR) confirming processing
  • Residency in Canada with the sponsor

IRCC aims to issue final decisions on new work permit applications within 60 days, providing a faster route for spouses and partners to join their loved ones in Canada.

Option 2: Visitor Visa

Eligibility for a Visitor Visa, or Temporary Resident Visa (TRV), hinges on meeting general requirements, including possessing a valid travel document, good health, and no criminal or immigration-related convictions. Additionally, applicants must convince immigration officers of their intention to return to their home country after visiting Canada.

With a service standard of 14 days for processing new visitor visa applications submitted outside Canada, this option offers another avenue for expedited family reunification.

Applicants may also require a medical exam and/or a letter of invitation from a Canadian resident. For spouses or partners sponsored for permanent residence, additional documents, such as proof of relationship and identity, may be necessary to support the application.

Both options can only be pursued after submitting a permanent residence application for spousal sponsorship and receiving an AOR from IRCC. However, it’s essential to note that while IRCC strives to meet service standards, processing times may vary.
